Terms of Service

1. The service

ShiftAnswer ("we", "us") designs, configures and operates AI voice agents ("Agents") on behalf of business customers ("Customer", "you"), using third-party telecommunications providers including Telnyx.

2. Your responsibilities

  • You are the caller of record for all outbound calls placed on your behalf and are responsible for complying with the TCPA, the Telemarketing Sales Rule, state telemarketing and recording laws, and all other applicable laws.
  • You must obtain and keep records of any consent required before an Agent calls a person, including prior express written consent for marketing calls.
  • You must scrub outbound lists against the National Do Not Call Registry and applicable state lists, and honor opt-out requests promptly.
  • You must not use the service for any purpose listed in our Acceptable Use Policy.
  • You are responsible for the accuracy of business information you give us to train your Agent.

3. AI disclosure and recording

Agents disclose that they are AI and that calls may be recorded. You agree not to ask us to remove these disclosures.

4. Fees

Fees are set out in your order form. Usage beyond plan limits is billed in arrears. Late amounts may result in suspension.

5. No guarantee of outcomes

AI Agents can make mistakes. Agents are not a substitute for emergency services, medical, legal or financial advice. You should not rely on an Agent for any decision where an error could cause harm.

6. Indemnification

You will defend and indemnify ShiftAnswer against claims arising from calls placed at your direction, your call lists, your content, or your breach of these Terms or applicable law.

7. Limitation of liability

To the maximum extent permitted by law, our total liability is limited to the fees you paid in the 3 months before the claim, and we are not liable for indirect or consequential damages.

8. Suspension and termination

We may suspend service immediately if we reasonably believe your use violates law or these Terms. Either party may terminate with 30 days' notice.

9. Governing law

These Terms are governed by the laws of the state stated in your order form.
